Fatwa number ( 1196 )
Q: He has an uncle named (A.) who has a house. It was said to him that his wife goes to his uncle (A.)'s house and frequently visits them, and they are annoyed by that. So he said to her: If you go to my uncle's house, you are divorced three times. Finally, it became clear to him that the statement about his wife visiting his uncle's house was not true. He asks about the divorce.
A. If the matter is as the questioner described, that he did not divorce his wife except based on what was said about her regarding her frequent visits to her uncle's house, and that they
are annoyed by her, and that it became clear to him that what was said about her was not true, then the divorce does not take effect; because the divorce is conditional on the situation, as he divorced her under the belief that what was said about his wife was true, and it was found to be otherwise, as he mentioned. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
