Q: I swore that my wife would not study and would not teach either, and my intention was that if she studied or taught, she would be divorced. Now I have agreed that my wife may study or teach, so what is required of me to allow her to do so before I permit
her to teach or study? Please issue a ruling for us, may Allah reward you, may Allah preserve you.
A: If your oath was coupled with a condition, such that you said to your wife, “By Allah, if you study or teach, you are divorced,” and then you broke your oath by her studying or teaching, then one divorce has occurred. You may take her back during the waiting period if this is not the third divorce. If the waiting period has ended, you may return to her with a new contract and a new bridal gift, provided this is not the third divorce. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
