Q: I previously said to my wife, the mother of my children, (N. H. 'A. H.), three times: "I divorce you" using this exact wording. Now I have a desire for my wife to return to me, so is she permissible for me?
A: Since you mentioned that you said to your wife, the mother of your children (N. H. 'A.), three times: "I divorce you," this wording is an indirect expression of divorce. If you intended divorce by it, or if you uttered it following a dispute between you and her, or if she asked you for a divorce and you uttered this phrase in response to her request, then based on this: what occurred from you three times
is established as a complete divorce. Based on this principle, she is not permissible for you until she marries a husband other than you, and he enters into marital relations with her and then divorces her, and she completes her waiting period, and this must not be done as a stratagem. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
