Q: HeThere was a misunderstanding between him and his wife, so he said to her: "I divorce you." His father then said to him: "You are joking, it is not a valid divorce, and she is not divorced." So I said: "I divorce you, I divorce you," to confirm to my father that my divorce was a valid one.He asks: Does he have the right to take back his wife given the circumstances described?
A: If the matter is as he described, that he said to his wife: “I divorce you,” and his father said to him: “You are not serious, and she is not divorced,” and he then said after his father finished speaking: “I divorce you, I divorce you,” to confirm to his father that his divorce is effective—then if this divorce was not the third of three divorces, and it was not for compensation, it is considered a revocable divorce. He may take back his divorced wife as long as she is in the waiting period; because his intention in repeating it was to confirm the first divorce. If she exits the waiting period without him taking her back, or if the divorce was for compensation, then he may return to her with a new contract and a new bridal gift, with her consent, along with
completing the pillars and conditions of the marriage contract. However, if the divorce was the third of three divorces, she is not lawful for him until she marries another husband, in a marriage of desire, not a marriage of dissolution. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
