Q: He divorced his wife by saying to her: "You are divorced, divorced, divorced," and he stated that he intended the second and third pronouncements to confirm the first. This occurred on 26/4/1394 AH, and on 4/5/1394 AH he took her back with the testimony of two witnesses. He asks about the validity of his taking her back?
A: If the matter is as he stated, that he divorced his wife by saying to her: "You are divorced, divorced, divorced," and that he intended his repetition to be for confirmation, then if this divorce was not the third of three, and there was no compensation, his divorce is revocable. He has the right to take back his divorced wife as long as she is in the waiting period. If there was compensation, or if she exited the waiting period without being taken back, and it was not the third divorce issued by him, he may return to her with a new contract and a new bridal gift, with her consent, while fulfilling the conditions and pillars of the marriage contract. However, if it was the third of three divorces, it is not permissible for him to return to her until she marries another husband, a marriage of desire, not a marriage of dissolution. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
