Q: If the husband of a free woman dies, what is the waiting period prescribed for her to remain in the house where her husband died? For example, my mother is in the Eastern Region; she, her husband, and their children are poor and living with my eldest brother. My father passed away in the hospital in the region. Is it obligatory for her to remain in her brother’s house, i.e., her son’s house? And what is the prescribed waiting period? Is it permissible for her to visit her second son? Or, more precisely, is it permissible for her to live with her second son? Since her eldest son has many children, and there is fighting between my brother’s children and my siblings, and my brother’s wife quarrels frequently with my siblings, which causes my mother distress. She does not wish to remain in this region. If she completes the prescribed waiting period with this wife, complications may arise, as her health condition is not good. Does she have the right to go visit her father and her brothers? And if one of her sons wants to take her to the countryside to relax her mind a little, is that permissible while maintaining the hijab? May Allah preserve your eminence and grant you His help and success in serving
Islam and the Muslims, and may peace and the mercy of Allah and His blessings be upon you.

A: It is obligatory for a woman whose husband has died, provided she is not pregnant, to observe the waiting period in her husband’s house for four months and ten days, and she must not leave the house for recreation or for visiting as long as she is in the waiting period. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
