The second question of Fatwa number ( 14271 )
Q2: One of my colleagues told me that he said to his wife: (You are haram, my mother is haram to me if you hide anything from me) and he meant by that the forbidden acts; because he suspected her of them. What is the ruling if she hides something from him? And if she informs him of what she did, is she halal for him because he made a condition? And what is the ruling of what he did
with it? Since he is, by Allah, regretful of what he did, and he has children from her, and she wants him, and he has started sleeping alone for fear that she has become haram for him, and he says: she informed him of what she did. Please inform us, may Allah reward you with good.
A2: If she informed him of the evil she did, then no zihar occurs, and likewise if she did not do anything. And if she did something of what the zihar was conditioned upon, then the zihar occurs, and upon him is the kaffarah before he touches her, and it is: freeing a slave, and if he does not find one, he fasts two consecutive months, and if he cannot, he feeds sixty poor people. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his companions.
