Q: I submit my case to your eminence, in which I ask Allah, then you, for guidance on the Islamic ruling regarding my following case: I divorced my wife, the mother of my only son, with one divorce, and it was registered with the judge of the Diriyah court.I divorced my wife, the mother of my only son, with one divorce, and it was registered with the judge of the Diriyah court. Then, after that, I wanted to divorce her a second time and brought witnesses for it, but it was not registered legally;because I did not bring the "Hafizat al-Nufus" (guardian of souls) to the court. I ask Allah, then you, for guidance on whether this divorce is valid, even if it was not registered legally? Since I did not pronounce it, but only intended it, and then finally I wanted to take her back, is she permissible for me? May Allah guide you to serve the Book of Allah and the Sunnah of His Messenger (peace and blessings be upon him).
A: If the reality is as you mentioned, that you intended the divorce, went to the court to divorce her, and left the court without registering it or pronouncing it, then no divorce takes place by that, and she remains in your protection, and you do not need to take her back. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
