Fatwa number ( 21410 )
Q: A man became angry and said to his wife: "I do not want you," on the date 2/2/1421 AH. Is this phrase considered a divorce, or is it considered an oath that requires expiation? Please inform us before it is too late. May Allah preserve you.
A: If you intended divorce with this phrase, then one divorce takes effect on you, and you may take her back as long as she is in the waiting period, unless this divorce was preceded by two other divorces, in which case she is not lawful for you until she marries another husband, he divorces her, and then you marry her with a new contract. And if you did not intend divorce with this phrase, then nothing is required of you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
