Q: My wife goes to the married neighbors without my knowledge, and when I return from work, I do not find her at home. This has happened several times, and I advised her not to go to them, but she repeated it. One day I got angry and took her to her parents’ house. I discussed it with her father, and they found that she was not in the right. I told them: “If she goes to these two houses a second time, she will not be my wife.” I do not know if she went a second time after I said this or not. I should mention that when I return from work, I find her at home. I ask for your guidance regarding this statement I made: “If she goes to these two houses a second time, she will not be my wife.” Is she forbidden to me, or what should I do? Please inform me; may Allah reward you and grant you the best reward.
A: If your intention in saying to your wife, “If you go, you will not be my wife,” was divorce, and then she went, one divorce takes place. You may take her back as long as she is in the waiting period, provided that two divorces did not precede this. If your intention in that statement was to prevent your wife from going and you did not intend divorce, and then she went, she is not divorced. The ruling in that case is the ruling of an oath, and its expiation is: feeding ten poor people, or clothing them, or freeing a believing slave. If you do not find the means to do so, then fast for three days. As for if you did not know that she went to the two houses or
one of them, there is no blame on you in cohabiting with her; because the original state is the continuation of the marital bond. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
