This is the first letter in our hands that we have received from Ahmad ibn Muhammad al-Yahya. Ahmad ibn Muhammad ibn Yahya says in this letter:
Peace be upon you, and Allah’s mercy and blessings, and after that:
After thanking the honorable scholars who answer the questions and inquiries of the listeners, and asking for the program to be extended, he says: My husband died, and he did not specify a mahr for me, nor did he consummate the marriage. Do I have the right to the mahr of her like (mahr al-mithl) or half of the mahr of her like, or the consolation gift (mut'ah)? May Allah guide you.
Answer: If a woman’s husband dies and he did not specify a mahr for her, and he did not consummate the marriage, she is entitled to the mahr of her like (mahr al-mithl). This is established from the Prophet (peace and blessings be upon him), as it is established that he was asked about such a case and ruled that she is entitled to the mahr of her like, without excess or deficiency. She must observe the waiting period ('iddah) and she is entitled to inheritance. This is established from the hadith of Ma'qil ibn Yasar.
The point is: From the hadith of Ma'qil ibn Yasar al-Ashe'ari, regarding a woman whose name is ... Buro' bint Washaq. Her husband died, and he did not specify a mahr for her, nor did he consummate the marriage. The Prophet (peace and blessings be upon him) ruled in her case that she is to be given the mahr of her like, without excess or deficiency. She must observe the waiting period ('iddah) and she is entitled to inheritance. Yes.
