Fatwa No. ( 2791 )
Q: I, the undersigned (M.S.), had my cousin’s daughter under my care, then she went and returned to her family and became upset. I said to one of her companions: “Handle it,” but he did not handle it. My intention was for her, and I asked her to return, but her father asked me for a paper stating that she is my wife, so I came to obtain a paper from your eminence.
A: If the situation is as you described, then no divorce takes effect on her based on what you mentioned, and she is considered to be in your protection. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
