Q: We are some of the students in the College of Education for Women in Jeddah . A discussion took place among us regarding the Shari'ah's view on the blood money for a person killed by mistake, and we differed and did not arrive at the correct answer to some of the questions; therefore, we are submitting them to you, hoping for an answer, and may Allah reward you with the best reward for us and for the Muslims. 1 - What is the amount of the blood money for a child killed by mistake in a car accident , and is it equal to the blood money of a woman and a man, or is it less? We ask for details on this. B - How much more is the blood money of a man than the blood money of a woman , or are they equal? C - If the person killed by mistake is not of the religion of Islam (from the Jews or the Christians ), what is the blood money due on the one who killed him, and to whom is it paid?
A: First : The blood money for a child killed by mistake after being born alive is like the blood money of a man, and the blood money for a girl killed by mistake after being born alive is like the blood money of a woman,
and it is half of the blood money of a male. Second : The blood money for a man and a woman who are victims of a mistake is equal in amounts less than one-third; if the blood money for the injury reaches one-third, her blood money becomes half of the man's blood money; for what was narrated by al-Nasa'i and al-Daraqutni through the route of 'Amr ibn Shu'ayb from his father from his grandfather, that the Prophet (peace and blessings be upon him) said:Sunan an-Nasa'i 4805Da'if (Darussalam) . Third : The blood money for a person killed by mistake from among the Jews and Christians is half the blood money of a Muslim, and the blood money for a female among them is half the blood money of a male among them; for what was narrated by Ahmad and al-Nasa'i and al-Tirmidhi through the route of 'Amr ibn Shu'ayb from his father from his grandfather, that the Prophet (peace and blessings be upon him) said: Mishkat al-Masabih 3496 And in another wording: Sunan Ibn Majah 2644Hasan (Darussalam) And they are the Jews and the Christians . It was narrated by Ahmad and al-Nasa'i and Ibn Majah , and it is paid to their heirs.

عقل الكافر نصف دية المسلمthe Messenger of Allah (ﷺ) ruled that the blood money for the people of the book is half of that of the blood money for the Muslims
قضى أن عقل أهل الكتابين نصف عقل المسلمينAnd success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
