Killing a man by mistake, collecting the full blood money, and the judge ruling for half the blood money
Machine translationRead the Arabic original
Fatwa number ( 14789 )
Q: A man killed another man by mistake with a car, and the blood money and donations from people of good were collected for him, amounting to 100,000 riyals. After two years from the incident, the court ruled for only half the blood money due to mutual fault between the killer and the killed. Is the remaining amount his right, or what?
A: If the situation is as you described, you must return the remainder to those who donated it, if you know them. If you do not know them and you find someone who has a blood money debt that he is unable to pay, you must direct this amount to him through the court. If neither of these applies, you must give charity with the amount exceeding the blood money required of you to the poor, or in the construction of mosques and similar charitable projects, with the intention of doing so on behalf of the owners. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
