Q: If a son is born and his maternal aunt takes him and he suckles her breast, and she raises him for a long period, and the aunt did not give birth to a child either before taking him or after, then she dies after a long time, and the uncle’s husband marries this son and he is in his house, then he bequeaths to him all his wealth, what is the ruling on the following matters: Is the breastfeeding established for him from this aunt?
A: The breastfeeding that establishes prohibition is what amounts to five breastfeedings or more within the two-year period. A breastfeeding is defined as: the child holding the breast and suckling milk from it, then releasing it to breathe or similar. If he returns to it and suckles milk from it, it is counted as a second breastfeeding, and so on. If the breastfeeding of the aforementioned child from the aforementioned aunt amounts to five breastfeedings or more within the two-year period, then he becomes her son through breastfeeding, even if she did not give birth to a child before or after him. And if it is less than five, or if there was no milk at all, then he is not considered her son by that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
