Q: I intend, if Allah wills, to marry my son to his maternal aunt's daughter, and
he was suckled by his maternal aunt, and he was also suckled by the same woman who suckled her, two years before her. However, he was not suckled by the girl's mother, and the girl was not suckled by her mother. The marriage contract is suspended until we consult your eminence, so please issue a ruling for us, may Allah reward you.
A: If the breastfeeding of both your son and your maternal cousin’s daughter by the woman mentioned was five times or more within the first two years, then it is forbidden for your son to marry her, because she has become his sister through breastfeeding. However, if their breastfeeding, or the breastfeeding of one of them, was less than five times, or if it occurred after the two years, then it is permissible for him to marry her. Allah the Exalted said:[Al-Baqarah 2:233], and He said: [An-Nisa 4:23] up to His saying: [An-Nisa 4:23], and the Prophet (peace and blessings be upon him) said: Sunan Ibn Majah 1937Sahih (Darussalam), and A'ishah (may Allah be pleased with her) said: It was in what was revealed of the Qur'an: "Ten known breastfeedings make marriage forbidden," then it was abrogated by: "Five known breastfeedings." حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْyour sisters through nursing
وَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِBreast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful.
يحرم من الرضاع ما يحرم من النسبIf a child sucks milk from the breast, even a little, then leaves it, this is considered one suckling.
