Q: My father married the widow of my maternal uncle, that is, my mother’s brother, who is also my father’s cousin. She had two daughters. I married one of them with her consent and the consent of her guardian, who was my grandfather and her grandfather at the same time. She has since borne my father three sons and two daughters, all of whom are my brothers and also my wife’s brothers. The marriage took place at a late stage, meaning after my father’s wife had given birth. I am troubled by doubts regarding the permissibility or prohibition of this. I ask for your ruling on this so that I may live my life with peace of mind.
A: If the situation is as you described, your father’s marriage to the woman who was your maternal uncle’s wife and who died is valid, provided that the marriage contract was concluded after her waiting period following your uncle’s death had ended. Likewise, your marriage to your maternal uncle’s daughter, who was born to the woman your uncle married and whom your father married after her death, is valid; for the original ruling is permissibility, and no legal impediment has been found that would take this out of the original ruling. The fact that her children from your father are your brothers on your father’s side, and her daughters from your maternal uncle are your brothers’ maternal sisters, has no effect. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
