Q5: Ahmad married his first wife, and they had children. Then he married a second wife, and they had children. He married one of his sons from the first wife to the sister of his second wife, meaning that Ahmad and his son have two wives who are sisters. What is the ruling? Also, the second wife gave her sister a baby boy, and she raised him and adopted him, meaning that this son, who is her sister’s son and her husband’s brother from the same father, is now registered in this family’s record. What is the ruling?
A5: First: It is permissible for a son to marry his father’s wife’s sister, provided that she is not his mother’s sister, but rather the sister of his mother’s co-wife, as in the question; because the original ruling is permissibility, and no obstacle exists that would necessitate deviating from it.
Second: It is permissible for her sister to raise this child, but it is not permissible for her to adopt him, and the rulings of sonship, such as inheritance and the like, are not established through adoption. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
