Fatwa number ( 8990 )
Q: A woman hates her husband, finding no fault in his character or religion, and she has returned to him the full amount of the bridal gift she received. Is this husband compelled to divorce his wife, even if he is attached to her and she hates him intensely?
A: If a woman hates her husband and fears that she will not be able to uphold the limits of Allah, then khul' (divorce at the wife's request for compensation) is prescribed in that case, by which she returns to him what he gave her of the bridal gift, and then he separates from her; based on the hadith narrated by al-Bukhari . If a dispute arises between them, the matter is referred to the judicial authority to adjudicate between them.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.

The wife of Thabit ibn Qays, that she came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah, I find no fault in Thabit in religion or character, except that I fear disbelief. The Messenger of Allah (peace and blessings be upon him) said: "Will you return to him his garden?" She said: Yes. So she returned it to him, and he ordered him to separate from her.
