Q5: I am a woman in my sixties, and I have nine children. Five years ago, problems arose between me and my husband that led to my leaving my home. One of my sons rented me a separate residence away from my husband, and I am currently living there with my children. My husband is married to another woman and has children from her. I have not asked him for a divorce, and he has not sought to bring me back to my home. Is there a sin on me if I continue to live away from my husband's home without a divorce? And is there a sin on me if I go out and perform the 'Umrah without his permission, or what is required of me?
A5: If the fault is yours, then you are sinful, and you are considered to be in a state of marital defiance (nushuz) toward your husband. You must repent and seek his satisfaction. If the fault is his, then there is no sin on you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
