Fatwa number ( 3176 )
Q: I inform you that I married for a sum of sixty thousand riyals (60,000), and I paid eighteen thousand riyals (18,000) of the mahr at the time of consummation, and then the wife passed away (may Allah have mercy on her), and she has a daughter, and the wife's father is demanding the remaining mahr. We hope you will issue a ruling on the remaining mahr and the portion her father has already received. Please give us a detailed ruling. May Allah reward you with good in this world and the bliss of the Hereafter.
A: The remaining amount in your debt from your wife's mahr is considered her property. After her death, it transferred to her heirs, and you are liable for your share of it according to your inheritance portion. Note that settling her debts and executing her lawful bequest, if any, takes precedence over the heirs in the estate.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
