Q: We are two men, and we have a full sister. Is it permissible for us to divide the inheritance equally, especially if that was the deceased’s wish, and if we are all willing?
A: If the matter is as described, then after settling the deceased’s debts, if any, and then carrying out his lawful bequest, if any, the remainder is to be divided among you: the male receives two shares, and the female receives one share. If some of the heirs waive their share in favor of another heir who is an adult of sound mind, that is permissible. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
