Q: If there is a tribe among the tribes who are united with one another and pay together what is called al-gharam, meaning: if a calamity befalls one of them, and may Allah protect us from that, and he is required to pay money, they divide it among themselves equally, and each pays his share and the debt placed upon him. If one of the members of this tribe dies due to a car accident or something similar, and blood money is distributed to his heirs, do the other members of the tribe, who are not heirs, have a share in this money or the blood money taken on account of this man?
A: The deceased’s wealth and his blood money — after settling his debt if he was in debt and executing his lawful bequest if he made one — belong only to his heirs, to be divided among them according to what Allah the Exalted specified in His Book and what His Messenger (peace and blessings be upon him) specified. No one from the tribe has the right to take anything from their share or the share of any one of them.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
