The estate is the right of the heirs unless they grant permission

The third question of Fatwa No. ( 19810 )
Q3: My wife passed away (may Allah have mercy on her) and left behind (gold jewelry). I collected it and wish to sell it. I gave charity from a portion of it on her behalf (may Allah have mercy on her). Is it permissible for me to give charity from it for myself, given that I have debts resulting from my marriage and the house I built to live in? She passed away (may Allah have mercy on her) and did not stay with me for more than a year and eight months. I know that my
wife's family said: We do not want anything from the gold or her house, may Allah reward them with good. And since I am a young man of 33 years old and I wish to marry another wife, if Allah wills.
A3: The gold and other items your wife left behind belong to her heirs, among whom you are included. If they permit you to take their share, you may dispose of it as you wish. If they do not permit it, you must give them their share. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
