Q: My father passed away, leaving behind an orchard with trees, as well as a wife who was not a relative and had no children. After my father’s death, she married another man. Does she have a right to this orchard for the duration of her life, meaning:
whatever is planted in the orchard, is she entitled to a share of it?

A: Of all the estate your father left behind, your father’s wife is entitled to one-eighth, which she owns in full, provided your father had no other wife: whether the estate is sold or utilized, such as the orchard mentioned, she is entitled to one-eighth of the sale price or one-eighth of the produce. This is after settling any debts your father owed and carrying out his lawful bequest. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
