Q1: A woman’s husband died, and the deceased had children from that woman or from another woman. The deceased left only a piece of land on which he built a house for residence and made it his home. Does that woman have a share in that house, even if she is married to another man who is far from the house? And if she has a share, how can she benefit from it?
A1: If a man dies and a woman inherits from his estate according to the Islamic law of inheritance, her marriage to another man after his death does not deprive her of her right to inherit from her first husband, by the consensus of the Muslims. Thus, this wife is given
one-eighth after the deceased’s debts are paid and his valid will is executed. If he had another wife or more, the one-eighth is divided among them. As for how to benefit from it, that is not our concern. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
