Fatwa No. ( 6029 )
Q: Is it permissible for a man to gift the Qur'an as mahr for his wife, and what is the procedure in this case if divorce occurs?
A: First: It is valid to make teaching a woman something of the Qur'an her mahr at the time of contracting marriage with her, if he does not find money, based on what is established in the two Sahihs from
Sahl ibn Sa'd (may Allah be pleased with him):
That the Messenger of Allah (peace and blessings be upon him) was approached by a woman who said: "I have offered myself to you." She stood for a long time, so a man said: "O Messenger of Allah, marry me to her if you have no need of her." He said: "Do you have anything to give her as charity?" He said: "I have nothing but my garment." The Messenger of Allah (peace and blessings be upon him) said: "If you give her your garment, you will sit without a garment. Look for something." He said: "I find nothing." He said: "Look for even an iron ring." He looked but found nothing. The Messenger of Allah (peace and blessings be upon him) said: "I have married her to you with what you have of the Qur'anأن رسول الله -صلى الله عليه وسلم- جاءته امرأة فقالت: إني وهبت نفسي لك، فقامت طويلا، فقال رجل: يا رسول الله: زوجنيها إن لم يكن لك بها حاجة، فقال: هل عندك من شيء تصدقها؟ فقال: ما عندي إلا إزاري، فقال رسول الله -صلى الله عليه وسلم-: إزارك إن أعطيتها إياه جلستَ ولا إزار لك فالتمس شيئا قال: لا أجد، قال: التمس ولو خاتما من حديد فالتمس فلم يجد شيئا، فقال رسول الله -صلى الله عليه وسلم-: "زوجتكها بما معك من القرآن
Agreed upon by al-Bukhari and Muslim. It is also permissible to present the noble Mushaf as her mahr; because the Mushaf is permissible to sell and buy in the most correct of the scholars' opinions. Second: In the case of divorce occurring before the husband fulfills what he named for her in the contract, she has the right to claim half of it if the divorce is before consummation, and the full amount if it is after consummation, unless the woman forgives that in both cases or one of them, or they agree on some permissible compensation. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
