Q: I married a woman about six years ago. Because she was an orphan with good character and gentle treatment, I promised her that I would not marry another woman over her except in one of three cases: (death, divorce, or a disabling ailment). As time passed, her financial situation improved: houses, a farm, and real estate. In addition, our marital and emotional family relationship has entered a barren autumnal phase. She also refused to move to live in my home because I no longer feel comfort and peace in her home. Furthermore, she has not borne any children during this entire period. I am considering marrying someone else, and she does not object to that. However, the problem remains of exiting safely from a promise I made to myself. Even if I were not thinking about marriage, my wife is advanced in age and is no longer able to perform the minimum rights of the marital relationship. Please advise us, may Allah reward you.
A: If the situation is as described, where circumstances have changed from the state for which she made that promise, there is no blame on you for marrying while she is still under your protection, and you must pay the expiation for an oath. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
