Q: Recently, an abaya has become widespread that is tailored to the body and tight, consisting of two thin layers of crepe fabric, with wide sleeves, and featuring buttons and embroidery, and it is placed on the shoulder. What is the ruling of the Shari'ah regarding such an abaya? Please issue a ruling, may Allah reward you, and we request

that you contact the Ministry of Commerce to prohibit this abaya and its like. A: The Shari'ah abaya for women, which is the (jilbab), is: that in which the intention of the Lawgiver is realized regarding complete covering and distance from fitnah (trial/temptation). Based on this, the woman's abaya must possess the following attributes: First: It must be thick so that what is underneath it does not show, and it must not have the property of clinging. Second: It must cover the entire body, be loose, and not reveal its contours. Third: It must be open only from the front, and the sleeve openings must be tight. Fourth: It must not contain adornment that draws attention to it; therefore, it must be free from drawings, decorations, writings, and logos. Fifth: It must not resemble the clothing of disbelieving women or men. Sixth: The abaya must be placed on the crown of the head from the beginning. Based on the foregoing: the abaya mentioned in the question is not a Shari'ah abaya for women, so it is not permissible to wear it; because the obligatory conditions are not present in it. Nor is it permissible to wear other abayas in which the obligatory conditions are not present. Nor is it permissible to import it, manufacture it, sell it, or promote it among
Muslims; because that is from cooperating in sin and aggression. And Allah (Exalted and Majestic is He) says:
but do not cooperate in sin and aggression. And fear Allah; indeed, Allah is severe in penalty.وَلاَ تَعَاوَنُوا عَلَى الإِثْمِ وَالْعُدْوَانِ وَاتَّقُوا اللَّهَ إِنَّ اللَّهَ شَدِيدُ الْعِقَابِ
[Al-Ma'idah 5:2]
, and the Committee, in clarifying this, advises the women of the believers to fear Allah the Exalted, and to adhere to the complete covering of the body with the jilbab, and the khimar from non-mahram men; in obedience to Allah the Exalted and His Messenger (peace and blessings be upon him), and to distance themselves from the causes of fitnah and being tempted. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
