Q3: If a person converts to Islam, and his family remains non-Muslim, and his parents die leaving him and his siblings an estate, it is clear that he has no right to inheritance. However, if they offer him what they consider his share, should he accept it? It has been said: he may accept it as a gift. If he is allowed to accept it as a gift, is it necessary for him to explicitly state to them that he is accepting this portion as a gift, or is an explicit statement not required and intention is sufficient?
A3: It is permissible for that Muslim and others like him to take what is offered to him from the wealth of his father and siblings, whether they are alive or dead, provided that taking it does not lead to fitnah (trial, discord or temptation) for him by drawing him to their religion or the like, and provided that the donors are guided in their worldly affairs, and that they knew he had no right to inheritance. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
