Q: The content is that a man bequeathed one-fifth of what he leaves behind, and excepted from that his residence for his descendants according to the Islamic law of inheritance, and that before his death he disposed of the house by selling it and buying another, and sold the other and bought a third, and so on, until he died and he had one house which is the residence of his descendants, and he asks: Does the aforementioned house enter into the one-fifth and does it have the same ruling as the first house?
A: If the matter is as mentioned in the question, then the house that he died with in his possession is a substitute for the house that he excepted in his bequest, so it does not enter into the one-fifth. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
