Q: There is a husband who took his wife to visit her sister in her house. When the day came for him to take her back to his house, she refused and said, "Let me stay here, or take me to my parents' house." He argued with her and pronounced one divorce: "You will not come to my sister's house again, nor see her." My sister has another sister, and I said, "You will not see her except if she is in the house of my other sister." This is the divorce. Please inform us whether this divorce includes my sister coming to my house or not? Please inform us about this; because some of us have no wealth except from one another, and maintaining
family ties has merit with Allah. Knowing that I have not divorced except this one divorce, and that my wife has not gone to my sister's house after the divorce until this day, and the divorce was in the month of Dhul-Qa'dah 1393 AH.
A: If the matter is as you described, that you divorced your wife one divorce, that she will not come to the house of your sister whom she wanted to stay with during the visit, and will not see her except in the house of your other sister—then your sister coming to your house does not fall under your divorce, neither the one with whom the dispute occurred during her visit nor the other. And you do not break your oath of divorce if your wife sees either sister in your house or in the house of the sister where the anger did not occur. Rather, you break your oath of divorce if your wife visits the sister whose house was the site of the anger. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
