Q: A man left a bequest in which he stated: I have allocated a third of my wealth, estimated at: fifteen thousand pounds for several charitable projects, knowing that this estimate of the third of the wealth was made in the year 1387 AH, and he passed away
in the year 1400 AH, and this third amounted to the equivalent of two hundred thousand Syrian pounds at the time of his death. In what manner is the bequest to be paid out?
A: If the situation is as described, where the third of his wealth on the day of his death increased beyond the estimate made on the day he made the bequest, then the amount that counts is the third of his wealth on the day of his death, not the day the bequest was issued for the third. Thus, the amount of the bequest in the case mentioned in the question is two hundred thousand Syrian pounds; because the bequest is obligatory to execute after the death of the testator, not before. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
