The first question of Fatwa No. ( 11354 )
Q1: My mother passed away and she has a mother and sons and daughters, some of whom are in need and some are not. My mother had a small amount of wealth, and she bequeathed it for the establishment of ongoing charity. I ask you to issue a ruling on how I should proceed: should I establish ongoing charity with all of her wealth or a part of it, and how should I act in a way that pleases Allah?
Vol. 1: It is prescribed that a bequest be one-third or less; for al-Bukhari and Muslim narrated in their Sahihs from Sa'd ibn Abi Waqqas (may Allah be pleased with him) who said:
The Messenger of Allah (peace and blessings be upon him) came to visit me when I was suffering from a severe illness. I said: “O Messenger of Allah, my illness has reached the state you see, and I have wealth, and I have no heir except my daughter. Should I give away all my wealth in charity?” He said: “No.” I said: “Two-thirds?” He said: “No.” I said: “Then half, O Messenger of Allah?” He said: “No.” I said: “Then one-third?” He said: “One-third, and one-third is a lot. It is better for you to leave your heirs wealthy than to leave them poor, begging from people.”جاءني رسول الله صلى الله عليه وسلم يعودني من وجع اشتد بي، فقلت: يا رسول الله، قد بلغ بي الوجع ما ترى، وأنا ذو مال ولا يرثى إلا ابنة لي، أفأتصدق بمالي كله؟ قال: لا، قلت: بالثلثين؟ قال: لا، قلت: فبالشطر يا رسول الله؟ قال: لا، قلت: فالثلث؟ قال: الثلث والثلث كثير، إنك إن تذر ورثتك أغنياء خير من أن تدعهم عالة يتكففون الناس
As for what exceeds one-third, it is distributed among the heirs, unless they permit the bequest, in which case there is no harm if they are guided. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
