The author (may Allah have mercy on him) said, regarding what he quoted from Sa'd ibn Abi Waqqas (may Allah be pleased with him): That the Prophet (peace and blessings be upon him) came to visit him in the illness that had befallen him, and that was in Makkah. Sa'd ibn Abi Waqqas (may Allah be pleased with him) was one of the emigrants who migrated from Makkah to al-Madinah, leaving their homeland for Allah (Mighty and Majestic). It was the custom of the Prophet (peace and blessings be upon him) to visit his sick companions, just as he would visit those among them who were visiting, because he (peace and blessings be upon him) was the best of people in character. Although he was the Imam who is followed, may Allah's prayers and peace be upon him, he was the best of people in character, the gentlest of them toward his companions, and the most affectionate toward them. So he came to visit him, and he said: O Messenger of Allah: "I have reached a state of pain as you see": meaning he was afflicted with a great, severe pain. "And I possess wealth": possessing much wealth, or he said: great wealth, meaning he had a lot of wealth. "And no one will inherit from me except my daughter": meaning he had no heirs by fixed shares except this daughter. "Should I give in charity two-thirds of my wealth": meaning two-thirds out of three? He said:

, I said: Should I give in charity half? : meaning the half.
He said: No. I said: One-third, O Messenger of Allah? He said: One-third, and one-third is a lot قال : لا ، قلت : بالثلث يا رسول الله ؟ قال : الثلث والثلث كثير
, so his statement: Should I give in charity two-thirds of my wealth: means giving it as charity. So the Prophet (peace and blessings be upon him) prevented him from that, because Sa'd in that state was ill with an illness from which death was feared. Therefore, the Messenger (peace and blessings be upon him) prevented him from giving in charity more than one-third, because a person who is ill with the illness of death, which is feared, it is not permissible for him to give in charity more than one-third, because the rights of others, namely the heirs, are attached to his wealth. As for one who is healthy, with no illness or with a minor illness from which death is not feared, he may give in charity as much as he wishes: one-third, half, two-thirds, or all his wealth, and there is no blame on him. But it is not recommended for him to give in charity all his wealth unless he has something with which he knows he will be self-sufficient regarding the servants of Allah. The important point is that the Messenger (peace and blessings be upon him) prevented him from giving in charity more than one-third, and he said:
One-third, and one-third is much or large. الثلث والثلث كثير أو قال : كبير

: and in this is evidence that if it is less than one-third, it is better and more complete. For this reason, Ibn 'Abbas (may Allah be pleased with them both) said: "If only people would reduce from one-third to one-quarter, because the Prophet (peace and blessings be upon him) said:
A third, and a third is a lot. الثلث والثلث كثير
"
, and Abu Bakr (may Allah be pleased with him) said: "I am satisfied with what Allah has chosen for Himself": meaning the fifth, so he bequeathed the fifth (may Allah be pleased with him). And by this we know that the practice of people today, and their bequeathing one-third, is contrary to what is best, even though it is permissible. But the best is that it be less than one-third, either one-quarter or one-fifth. Our jurists (may Allah have mercy on them) said: "And the best is to bequeath the fifth and not exceed it, following the example of Abu Bakr al-Siddiq (may Allah be pleased with him)". Then the Messenger (peace and blessings be upon him) said:
to leave your inheritors wealthy is better than to leave them in poverty إنك أن تَذر ورثتك أغنياء خير مِن أن تذرهم عالة
Sahih al-Bukhari 6373
: meaning that you leave the wealth and do not give it in charity, so that when you die and the heirs inherit it, they become wealthy with it. This is better than leaving them poor: meaning you do not leave them anything.
Begging from people يتكففون الناس
: meaning they ask people with their palms, give us, give us.
And in this is evidence that if a deceased person leaves wealth for the heirs, that is better for him. A person should not think that if he leaves wealth and it is inherited from him by force, that he has no reward for it. No, rather he has a reward. So much so that the Messenger (peace and blessings be upon him) said:
to leave your inheritors wealthy is better than to leave them in poverty إنك إن تذر ورثتك أغنياء خير من أن تذرهم عالة
Sahih al-Bukhari 6373
: meaning
Begging from people يتكففون الناس
, because if you leave the wealth for the heirs, they benefit from it and they are relatives. And if you give it in charity, the distant ones benefit from it. And charity to a relative is better than charity to a distant one, because charity to a relative is charity and maintaining family ties. You never spend anything on maintenance desiring the Face of Allah by it, but that you are rewarded for it, even what you appoint for your wife.' Sad said, 'Messenger of Allah, will I be left here in Makka after my companions have departed for Madina?' The Messenger of Allah, may Allah bless him and grant him peace, said, 'If you are left behind, and do sound deeds you will increase your degree and elevation by them. Perhaps you will be left behind so that some people may benefit by you and others may be harmed by you. إنك إن تذر ورثتك أغنياء خير من أن تذرهم عالة يتكففون الناس ، وإنك لن تنفق نفقة تبتغي بها وجه الله إلا أجرت عليها ، حتى ما تجعل في فِي امرأتك ، قال : فقلت : يا رسول الله ، أُخلَّف بعد أصحابي ؟ قال : إنك لن تُخلَّف فتعمل عملا تبتغي به وجه الله إلا ازددت به درجة ورفعة ، ولعلك أن تُخلَّف حتى ينتفع بك أقوام ويضرَّ بك آخرون
