Q3: A man intends to perform Hajj and shaves his beard on the 2nd of Dhul-Hijjah, and he did not know, and he went after that on the fifth day. Is it permissible for him to pay a fidyah or not?
A3: If he shaved his beard before entering the state of ihram, he is a sinner for shaving his beard, and he must seek forgiveness from Allah and repent to Him, and there is no fidyah upon him, but it is obligatory for him to let his beard grow and not return to shaving it or cutting it; because the Prophet (peace and blessings be upon him) commanded letting the beard grow and leaving it long, and commanded cutting the moustache. And if it was after entering the state of ihram, he has disobeyed by shaving it and committed a prohibited act among the prohibitions of ihram, and it is obligatory for him, by committing it, to slaughter a sheep that is acceptable for the 'Id sacrifice in Makkah at any time, and distribute it to its poor and not eat from it, or feed six poor people: each poor person half a sa' of what he usually eats, or fast for three days, except if he was forgetting that he was in the state of ihram when he shaved it, or ignorant of the prohibition of shaving in the state of ihram, then there is no fidyah upon him.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
