Q: My father (may Allah have mercy on him) passed away as a result of a traffic accident caused by a non-Muslim Indian, and the judge ruled in his favor for blood money. Before his death (may Allah have mercy on him),
he had bequeathed one-third of his wealth to charity and righteous deeds, and we carried this out after distributing his inheritance. My question to you, O honorable one: Is one-third of the blood money taken and included in the bequest he made before his death, or is it distributed among the heirs, each of whom may do with it as he wishes? Please inform us, may Allah reward you with the best reward, and may Allah preserve you and protect you.

A: The aforementioned one-third is taken from the entire estate of the deceased, including his blood money and other assets, after paying off his debts if he had any. Therefore, one-third of the wealth distributed from the estate before the bequest was executed must be recovered from the hands of the heirs; each of them must return one-third of what he received. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
