Q: I inform you that I have bequeathed one-third of my house located in Manfuha in the city of Riyadh to a charity and a sacrificial offering. When I consulted the Real Estate Development Fund, they said: The house is cleared of the bequest, and there is no objection to giving you a loan. Since the house is old, made of mud, and unfit for habitation, I ask Allah, then your Eminence, to order whoever is responsible to clear my house of this bequest. I, the testator, am alive and well, and by my statement in the deed that "one-third is a completed endowment for charity," I did not intend an immediate endowment, but rather intended to perform the act with it after my death.
A: It is permissible to revoke a bequest, because it does not become binding except upon death. Accordingly, the aforementioned house, which is recorded in the attached deed No. 68 dated 29/4/1399 AH, issued by the honorable judge of the court of
Riyadh, the Shaykh: Abd al-Rahman ibn Faris, it is permissible for you to revoke the bequest of it, and consequently, it will be free. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
