Q1: My mother (may Allah have mercy on her) passed away and bequeathed her one-third to me and my younger brother equally by will. However, the one-third is livestock. I have a job, and my brother also has a job. The one-third remains with my father, who is a Bedouin. I have younger siblings from my mother, as well as from my father, but they do not know how to handle this one-third. My father gives charity from it. I do not wish to sell these animals for fear that the line will be cut off. What is your opinion on this matter? I ask for your guidance on this. May Allah reward you with good.
A1: What your father did by giving charity from the one-third is correct, and he did well in that. As for selling the bequeathed livestock or not, it is prescribed for you to look into what is most beneficial. If selling them is more beneficial, sell them and place their price in a house, shop, or palm trees, so that this becomes an endowment for the mother, and its produce is spent on what she mentioned in her will. If keeping the livestock in your father's hands is more beneficial, then you have no right to sell them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
