Fatwa number ( 6437 )
Q: I inform your eminence that my father passed away (may Allah have mercy on him) and bequeathed one-third of his wealth for a sacrifice for him, his parents, his wife, his brothers, and his sisters. It is in my possession, and he owned only one house. After its sale and the settlement of the estate, the one-third amounted to (86,666 riyals only). I have performed the sacrifice from this amount for three years, and (83,366 riyals) remain. Since the heirs cannot increase the amount or buy a house due to their poor financial condition, and I am supporting my mother, the deceased’s wife, and my widowed sister, and my financial situation is weak
and I am unable to increase the amount, I ask you to inform me of what you consider appropriate regarding the remaining amount in such a case from the perspective of Islamic law?
A: If the situation is as described, there is no blame on you for not increasing it. It is possible to buy a property with it in any place that suits this amount, even if it is small, such as a shop or the like, or to invest it in a property that generates income so that the sacrifice is taken from its proceeds. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
