Q: I have attached a copy of my grandmother Hayla bint al-Hamidi's will. I ask for your ruling on what I should do with the surplus of the rental income from her house after carrying out the specified sacrifice, because its rental income has become more than the cost of the sacrifice.
Upon reviewing the will, we found the following text: This is what Hayla bint Muhammad al-Hamidi has bequeathed. She has bequeathed the house known as her house, which is a public trust (sibala) in the hands of Muhammad and his brothers. Whoever needs it may reside in it, and whoever Allah has made wealthy may offer a sacrifice. Its scribe, 'Abd al-'Aziz ibn Ahmad ibn 'Abd Allah, attests to this, and its date was 1317 AH.
A: Whoever among Muhammad and his brothers is in need, he is to be housed. When they become self-sufficient, they offer the sacrifice, and the surplus is set aside as a sum for the maintenance of the house, while the remainder is spent on acts of charity under the supervision of the trustee. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
