Q: What is the ruling on disposing of a plot of land located at a corner outside the qiblah of al-Ruwat' Mosque, which is attached to the aforementioned mosque, by building a house for the mosque's imam on it? His Eminence mentioned that the plot measures 7 × 6 meters and is not suitable for incorporation into the mosque due to the market's curve over it, and incorporating it would cause the flow of the market to be diverted, even though the mosque is large and does not need it. The aforementioned land, once built upon as a house for the mosque's imam, will be an endowment (waqf) for this mosque for its imam or mu'adhdhin, whichever of them is in need. If both are in need, its income will be shared between them after its repair.
A: If the matter is as stated by His Eminence Shaykh 'Abd al-Rahman ibn Faryan regarding the unsuitability of this land for addition to the aforementioned mosque,
and its sufficiency with its spacious land, and the desire to build it as a house endowed for the aforementioned mosque for its imam or mu'adhdhin, whichever is in need, and since this plot, although attached to the aforementioned mosque, does not cease to be attached to the mosque by being built upon in the manner described in the inquiry, and there is a preponderant benefit for the mosque in this over adding it to the mosque, then the Committee issues a fatwa permitting this, provided that the aforementioned disposal is carried out by Shaykh 'Abd al-Rahman and under his supervision, and that the endowment deed of the aforementioned land is registered after its construction. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
