Q: If a man or a woman endows land in the name of a mosque, is it permissible to build residential houses on it, or is it not permissible? Or shops for rent or not?
A: If a person endows land in the name of a mosque, it is permissible for him to build houses on it that are annexed to the mosque for the residence of its imam, its mu'adhdhin, and its caretaker, or to rent them out so that their rent is spent on its repair and what is necessary for it. It is also permissible to build shops on it to be rented out, and to spend from their rent on the mosque's needs, such as the wages of employees,
its renovation, the purchase of its furnishings, and the like of what it requires, provided that this does not harm the intended benefit of building the mosque, such as restricting the space for the worshippers or the like of that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
