Conditions for the dispensation in travel

Machine translationRead the Arabic original
The first question of fatwa number ( 1328 )
Q1: Is it a condition for a traveler to be permitted to break his fast during his journey in Ramadan that he be traveling on foot or on a mount, or is there no difference between a pedestrian, a rider on a mount, and a rider in a car or airplane? Is it a condition that the travel involve a hardship that a fasting person cannot bear? And is it better for the traveler to fast if he is able, or is it better for him to break his fast?
A1: It is permissible for a traveler on a short journey to break his fast during his travel, whether he is walking or riding, and whether his riding is by car, airplane, or otherwise, and whether he is fatigued by his travel with a fatigue that prevents him from fasting or not, and whether he is overcome by hunger or thirst or none of that befalls him; because the Shari'ah granted the dispensation to the traveler on a short journey to break his fast, shorten the prayer, and similar dispensations of travel, without restricting it to a type of vehicle or to a fear
of fatigue, hunger, or thirst. The Companions of the Messenger of Allah (peace and blessings be upon him) used to travel with him on his expeditions in the month of Ramadan, some of them would fast and some would break their fast, and they did not blame one another. However, it is more emphasized for the traveler to break his fast in the month of Ramadan if fasting becomes difficult for him; due to intense heat, roughness of the path, distance of the journey, and continuous travel, for example. It is narrated from Anas :
We were with the Messenger of Allah (peace and blessings be upon him) on a journey, so some of us fasted and some broke their fast. Those who broke their fast girded themselves and did the work, while those who fasted were weakened from some of the work. The Prophet (peace and blessings be upon him) said: "Those who broke their fast have gone ahead today with the reward."
And breaking the fast in travel may become obligatory due to an urgent matter that necessitates it, as in the hadith of Abu Sa'id al-Khudri (may Allah be pleased with him), who said:
We traveled with the Messenger of Allah (peace and blessings be upon him) to Mecca while we were fasting. He said: "We stopped at a place, and the Messenger of Allah (peace and blessings be upon him) said: 'You are near your enemy, and breaking the fast is stronger for you.' So it was a dispensation, and some of us fasted and some broke their fast. Then we stopped at another place, and he said: 'You will face your enemy in the morning, and breaking the fast is stronger for you, so break your fast.' So it was an obligation, and we broke our fast. Then he said: 'I have seen us fasting with the Messenger of Allah (peace and blessings be upon him) after that on a journey.'"
Narrated by Muslim. And as in the hadith of Jabir ibn 'Abd Allah (may Allah be pleased with them both), who said:
The Messenger of Allah (peace and blessings be upon him) was on a journey and saw a man over whom the people had gathered and shade had been placed. He said: "What is the matter with him?" They said: "He is a fasting man." The Messenger of Allah (peace and blessings be upon him) said: "It is not from righteousness that you fast on a journey."
Narrated by Muslim. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
