Q: I am the agent of the heirs, who are five sons and a daughter. The judge appointed me over them and their property to increase it until they reach maturity. The eldest son has reached the age of maturity and wants to get married. Is it permissible for him to marry using the shared estate of the heirs, given that his share of the estate is not sufficient for the cost of marriage? And is it valid for us to give him his share of the estate and pay the remaining cost of marriage from the heirs' share, and write a document stating that he will repay the heirs' share? Please inform us.
A: It is not permissible for you to take anything from the minors' share to contribute to the marriage of one of them who has reached maturity, even if he is their brother and you have secured a written document from him obligating him to repay the minors for it. This is because it is obligatory for you to work with the minors' share for their benefit, and there is no benefit for them in taking something from their share to help one of them who has reached maturity. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
