Q: We inform Your Eminence that the state, may Allah protect it, provides an annual allowance through social security to some disabled individuals, both sons and daughters, in all regions of the Kingdom, including the Bisha region, where this allowance is distributed to some of the disabled individuals among us and handed over to their guardians. The guardians of these disabled individuals spend the allowance on their personal and agricultural interests, and on their other children, without paying attention to the care of these disabled individuals, as they neglect them and leave them without any notable care. It is known that some of the guardians of these disabled individuals receive another allowance from social security and have other income from jobs and agricultural harvests, and some of their children are employed in government jobs. The question: Is it permissible for the guardians to dispose of this allowance for their personal and agricultural interests and others, and to neglect the care of these disabled individuals? Or is it obligatory to accumulate it for them until they reach maturity and spend it on them and raise them in the best manner and condition? And is it permissible to give charity on behalf of these disabled individuals from this allowance provided by the state, given that they are disabled and unable to perform their religious duties due to their mental illness? Your Eminence, we request the kindness of a written response so that their guardians may know what is their right and what is their duty, and so that the benefit may extend to the Muslims in that region and elsewhere.

A: First: The funds allocated by the state for the disabled must be spent by the guardians on the interests of those for whom they were allocated. It is not permissible for the guardians to seize them and neglect the interests of those for whom they were distributed. However, it is permissible for fathers to consume from them if they need them, in a manner that is customary and does not harm the disabled individuals. Second: It is obligatory for the guardians of minors to pay the zakah of these funds if they reach the nisab and a lunar year has passed over them, but giving charity on their behalf from them is not permissible. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
