Q: We have heard from some people that it is permissible to sponsor Indians, Pakistanis, and others to reside in Kuwait or Saudi Arabia in exchange for a sum of money, on the pretext that this Indian is my driver or cook, or so on, when in fact he is not, but rather he lied to the authorities. Among these sponsored individuals are both disbelievers and Muslims. Some people claim that it was you, Your Eminence, who permitted this. We, in turn, wish to verify and clarify the matter. We ask you to inform us of this, and if you would be kind enough to provide the answer in writing.
A: If the matter is as described, it is not permissible for a person to bring in workers on the basis that they are his workers, and then leave them to work for other people while taking, for example, five hundred riyals from each of them in exchange for sponsoring them. The basis for the prohibition of this is that he takes this amount from the worker without compensation, so it is consuming wealth unjustly. It involves lying, and it also
involves deceiving the one in authority and violating the state’s regulations, which prohibit this in consideration of the public interest. It also creates the opportunity for an increase in incidents in society as a result of the large number of corrupt workers. No fatwa has been issued by me or by the Permanent Committee for Scholarly Research and Ifta permitting this. Whoever claims that has erred or lied. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
