Q1: I took on the guardianship of an orphan from our brothers the emigrants in Afghanistan, through the International Islamic Relief Organization, the Madinah al-Munawwarah office, seeking thereby the pleasure of Allah. I wish for it to continue as a charity for the sake of Allah even after my death, with the guardianship transferring to another orphan whenever the current one reaches the age of majority, and so on. Do I have the right to make a bequest for this now, and can it be deducted from my retirement benefits after my death, especially since I am a government employee and my retirement benefits cover this? I hope you will clarify, Your Eminence, how it can continue after death and the method of making the bequest.
A1: It is prescribed for you to make a bequest for the guardianship of the orphan after your death, and this is to be taken from one-third of your estate. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
