Q: We work in the supervision and tracking of merchants' goods of all kinds, from fruits and vegetables to canned goods, etc., from their exit from the ship until the merchant receives them. The question is: Is it permissible for us to eat from these goods, such as a few bananas or oranges, or to drink a box of juice that we eat from and do not carry with us? We do not open a new, sealed carton, but rather from what we see open in front of us, either by the customs after inspection or opened during its unloading from the ship. We take care to keep the amount we eat small—meaning: we eat a very small amount—so that we are certain that what we eat or drink will not cause the merchant any harm; because most merchants add an extra carton or more as a precaution against spoilage, loss, or anything else. You may ask: Why do they eat? The colleagues say: We are working, and the bananas or oranges are in front of us, and the company workers and truck drivers eat in front of us, and we cannot prevent them, nor can the merchant. In fact, some merchants open a box for the workers to eat
from it. You know, a person might perhaps reach out for a banana, an orange, a box of juice, a box of milk, or any type of goods, and eat or drink, perhaps due to a feeling of hunger, or seeing others eating, or the appeal of the appearance, or for any other reason. And does this have a connection to the saying of Allah the Exalted: We do not bear any sin. We hope you will issue a ruling for us, may Allah protect you and guide you to what He loves and is pleased with.
A: It is not permissible for you to eat anything from the merchants' goods except with the permission of their owner; because it is established that the Prophet (peace and blessings be upon him) said:Sunan al-Bayhaqi 7:67 . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
