The Hadith: (The blood of a Muslim is not lawful except in one of three cases) Who is the one who abandons his religion?

Machine translationRead the Arabic original
The Shaykh : This is what Salim al-Awfi says: Ibn Mas'ud narrated from the Prophet (peace and blessings be upon him) that he said in a hadith agreed upon by al-Bukhari and Muslim:
The blood of a Muslim man, who testifies that none has the right to be worshipped Allah, is not lawful except for one of three cases: The (previously married or) married adulterer, a life for a life, and the one who leaves the religion and parts from the Jama'ah (the community of Muslims.) لا يحل دم امرئ مسلم يشهد أن لا إله إلا الله وأني رسول الله إلا بإحدى ثلاث الثيب الزاني ، والنفس بالنفس ، والتارك لدينه المفارق للجماعة
Jami` at-Tirmidhi 1402Sahih (Darussalam)

The questioner : There is a difficulty, O Shaykh.

The Shaykh : What is it?

The questioner : The difficulty is that...

The Shaykh : The correct view is that the one who abandons his religion is the apostate.

The questioner : The apostate... the Messenger (peace and blessings be upon him)...

The Shaykh : Yes, because if he abandons his religion, he exits Islam. I mean, does it confuse you that he is one who abandons his religion while being a Muslim?

The questioner : No...

The Shaykh : The married adulterer, and he is a known Muslim; the life for a life, and he is a Muslim; the one who abandons his religion is a disbeliever, so he is a Muslim by virtue of what he was, before he abandoned his religion.
The Reader: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, Lord of the worlds, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions. Al-Bukhari (may Allah have mercy on him) said: Chapter: The saying of the Prophet (peace and blessings be upon him):
Perhaps the one it is conveyed to is more understanding than the one who heard it. رب مبلغ أوعى من سامع
Jami` at-Tirmidhi 2657Sahih (Darussalam)
.

The Shaykh : We continue with the brother's question. Yes, there is also this, meaning, suppose this occurred in the month of Ramadan. Did this question occur at night or during the day?
The Student: It occurred at night...

The Shaykh : So there are two possibilities now, yes.

The questioner : ... ؟

The Shaykh : Regarding the obligation of abstaining. That is, the Messenger did not tell him to abstain, because if it had been during the day and he had not ordered him to abstain, there would have been evidence for those who said that abstaining is not obligatory for him, but at night there is no evidence.

The questioner : Shaykh... during the day, it might be from far away...

The Shaykh : It is not apparent, it is not apparent, there might be a moon.
